Partner app terms of use

These terms apply when you use Upelo Partners (for tablets) or Upelo Light (for phones) — the apps restaurant owners and staff use to manage orders, menu availability, receipt printers and outlet settings for a restaurant that subscribes to the Upelo platform. The commercial relationship between the restaurant and Upelo, including fees and service levels, is governed by the agreement between the restaurant and Upelo; these terms cover your personal use of the apps. By signing in you agree to them.

Eligibility

You may use the apps only if a restaurant on the Upelo platform has authorised you to do so. Accounts are not created in the apps: Upelo creates the restaurant and its owner account during onboarding, and owners invite staff through the Upelo web portal at partners.upelo.io. Your access is tied to the role and outlets the restaurant assigns to you, and the restaurant may change or withdraw it at any time.

Your account and credentials

You sign in with your email address and password, plus a one-time code sent to your email address on a new device. Keep your credentials confidential and do not share your account with anyone — every action taken while signed in is attributed to you. Tell the restaurant owner immediately if you believe your account has been compromised; the owner can remove access from the web portal.

Acceptable use

Use the apps only to manage the restaurant you are authorised for and only in the way the restaurant has instructed. Do not attempt to access accounts, outlets or restaurants you are not assigned to; do not probe, disrupt or overload the platform or bypass its security; do not copy, reverse-engineer or resell the apps; and do not use them for anything unlawful. Upelo may suspend an account used in these ways.

The restaurant's responsibilities

The restaurant is responsible for how it uses the platform: for accepting, preparing and fulfilling the orders it receives, for the accuracy of its menu, prices, opening hours and outlet details, for handling refunds and complaints from its customers, and for the personal data of its customers in line with its own privacy policy and applicable law. Upelo processes customer data on the restaurant's behalf and does not take over these obligations. Owners are responsible for the accounts they create and for removing access when someone leaves.

Service availability

Upelo works to keep the apps and the platform available and accurate, but they are provided "as is" and "as available", without any warranty that they will be uninterrupted, error-free or fit for a particular purpose. Maintenance, network problems, device issues or third-party outages (for example push-notification or payment providers) can affect the service. Keep a fallback in place for taking orders if the apps are unavailable.

Limitation of liability

To the fullest extent permitted by law, Upelo is not liable for lost revenue, lost profits, lost data or any indirect or consequential loss arising from your use of the apps, including orders missed because a device was offline or notifications were turned off. Nothing in these terms excludes liability that cannot be excluded by law. Any liability Upelo has towards the restaurant is governed by the agreement between the restaurant and Upelo.

Intellectual property

The apps, the platform and their content belong to Upelo and its licensors. The restaurant's own content — its menu, images, branding and business data — remains the restaurant's. You receive only a limited, revocable right to use the apps on the restaurant's behalf.

Termination

The restaurant can end your access at any time by removing your account in the web portal, and you can delete your own account from within the apps (see upelo.io/partners/account-deletion). Upelo may suspend or end access to the apps if these terms are breached, if the restaurant's subscription ends, or if required by law. When access ends, your profile is deactivated and your personal data is handled as described in the partner app privacy policy; the restaurant's business records remain with the restaurant.

Governing terms and changes

Commercial terms — including fees, service levels, data processing and the law and courts that apply to disputes — are set out in the agreement between the restaurant and Upelo, which takes precedence over these terms if they conflict. These terms may be updated from time to time; the date on this page shows the latest version, and continuing to use the apps after an update means you accept the updated terms.
